It’s no exaggeration to say that the writer Nora Roberts has shaped how generations of people, especially women, think about relationships and sex — not to mention, what makes a great story. Before Roberts, the romance genre was dominated by tepid and virginal women who were overpowered by brooding men. As one romance critic told me, “Nora Roberts is the sun” around which the entire genre orbits. I was a teenager when I started sneaking into my older sister’s room to steal her Nora Roberts books. Love in a Nora Roberts book wasn’t about conquest and submission, as it was in most romance novels at the time, but rather about equality and partnership.

Colleges and universities across the country are scrambling to find legal means of maintaining the levels of diversity they would like to see. Though barred from actively using race as a factor, they will still “see” race in signifiers such as name, ZIP code and, perhaps most notable, what students say about themselves in their essays. “Nothing in this opinion should be construed as prohibiting universities from considering an applicant’s discussion of how race affected his or her life, be it through discrimination, inspiration or otherwise,” he wrote. The justices have simply replaced Chevron’s rule of judicial deference with its polar opposite, a new rule that goes by the name of the major questions doctrine. But how to tell a major question from an ordinary one? The Heller decision in 2008 opened the Second Amendment door a crack, granting individuals the right to keep a handgun at home for self-defense. The question in the case is whether the Second Amendment allows the government to bar gun ownership by an individual under a restraining order for domestic violence. That the answer actually might be “no” — domestic violence wasn’t even a concept in the 18th century, when the Second Amendment was adopted — is too astonishing to contemplate.

“Before Brown, schoolchildren were told where they could and could not go to school based on the color of their skin,” the chief justice wrote in Parents Involved. “Brown did not raise the issue of whether states could use race-conscious classifications to integrate schools,” wrote the legal scholar Joel K. Goldstein in a 2008 analysis and critique of Roberts’ opinion in Parents Involved. This, you might say, is the Roberts two-step. What’s left is the mark of racism, that is, race. A landmark case about the legitimacy of race hierarchy — Brown v. Board of Education — becomes, in Roberts’s hands, a case about the use of race in school placement.

The Supreme Court ruled today that the race-based admissions programs that have long been used by elite universities to increase diversity among their student bodies were unlawful under the Equal Protection Clause of the 14th Amendment. The ruling — decided 6-3 along ideological lines — upended decades of jurisprudence and would very likely drastically reshape the college admissions process. “This was a momentous decision,” my colleague Anemona Hartocollis, who covers higher education, told me. The five other conservative justices signed on to Roberts’s opinion, while the three liberal justices dissented. In a rare move that signals profound disagreement, Justice Sonia Sotomayor summarized her dissent from the bench: “The devastating impact of this decision cannot be overstated,” she wrote.
